These Terms of Service ("Terms") govern your access to and use of the Affirmed mobile application and related services (the "Service"), operated by AFFIRMED.IO LTD ("Affirmed", "we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms.

1. Important — please read first

1.1 Not a medical service

Affirmed is a self help wellness app. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

The Service is not designed to diagnose, treat, cure, or prevent any condition. It does not replace therapy, counselling, medication, or professional care.

If you are experiencing a mental health crisis or thoughts of self harm, contact a qualified professional or emergency services immediately.

1.2 Personal responsibility

You are responsible for decisions relating to your health and wellbeing. Do not make medical decisions based on the Service.

1.3 Recovery features

Recovery and habit features are supportive tools only and not treatment programmes.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you confirm you meet this requirement.

3. Your account

3.1 Registration

You must provide accurate information and keep it updated.

3.2 Security

You are responsible for your account and credentials. Notify us at info@affirmed.io if you suspect unauthorised access.

3.3 Account use

Accounts are personal and cannot be shared, sold, or transferred.

4. Your content

4.1 Definition

Your Content includes anything you create or submit in the Service.

4.2 Ownership

You retain ownership of your content.

4.3 Licence

You grant us a limited licence to use your content to operate the Service. This ends when your content or account is deleted, subject to backup retention.

We do not sell your content or use it to train AI models.

4.4 Acceptable use

You must not submit content that is illegal, harmful, abusive, infringing, or promotes self harm or unsafe behaviour.

5. AI generated content

5.1 Use of AI

The Service uses third party AI providers to generate content. The Service uses third party AI providers including OpenAI for text, artwork, and chatbot functionality, and ElevenLabs for text to speech generation.

5.2 Limitations

AI content may be inaccurate or inappropriate. It is not professional advice.

We do not guarantee any emotional, behavioural, or wellbeing outcomes.

5.3 Use of outputs

AI generated content is for personal, non commercial use only.

We may use anonymised, non identifiable outputs to improve the Service.

5.4 Limits

We may apply usage limits to AI features.

6. Subscriptions and payments

The Service is currently free.

If paid features are introduced:

Subscriptions will be clearly presented before purchase
Subscriptions renew automatically unless cancelled
You can manage subscriptions through your app store account

Payments are processed by third parties such as Apple App Store, Google Play, or Stripe. We do not store full payment card details.

Purchases made via Google Play are subject to Google Play billing terms. Purchases made via Apple are subject to Apple App Store terms.

Refunds are handled by the platform through which the purchase was made, except where required by law.

7. Intellectual property

The Service and its content are owned by Affirmed or its licensors.

You are granted a personal, non transferable licence to use the Service.

You must not copy, reverse engineer, or misuse the Service.

9. Third party services

We rely on third party providers. Their services are governed by their own terms. We are not responsible for their practices.

10. Service availability

We may modify or discontinue the Service at any time.

We do not guarantee uninterrupted access.

We are not responsible for loss of data except where required by law.

We are not liable for delays or failures caused by events outside our control.

11. Termination

11.1 Your rights

You may stop using the Service and delete your account at any time.

11.2 Our rights

We may suspend or terminate accounts for breach, misuse, legal reasons, or service discontinuation.

11.3 Effect of termination

Termination does not entitle you to refunds except where required by law.

Certain provisions continue after termination.

12. Disclaimers

The Service is provided as is without warranties.

We do not guarantee accuracy, availability, or results.

Nothing excludes liability that cannot be excluded by law.

13. Limitation of liability

To the fullest extent permitted by law:

We are not liable for indirect or consequential damages.

Our total liability is limited to the greater of the amount paid by you in the last 12 months or £100.

14. Indemnity

You agree to indemnify us against claims arising from your misuse of the Service or breach of these Terms.

15. Governing law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales have jurisdiction, except where consumer laws allow otherwise.

16. General

These Terms and the Privacy Policy form the entire agreement.

If any part is unenforceable, the rest remains valid.

We may assign our rights. You may not assign yours.
